Terms and Conditions
The information contained within this document pertains to the WØRKS online store, trading under the name WØRKS Pty Ltd and herein referred to as ‘WØRKS’. Please read these terms and conditions carefully. Making a purchase, signing up for the newsletter, or submitting any order via this website signifies agreement to this set of Terms.
Products displayed on the site may be purchased using a secure online Visa or MasterCard transaction facility or via PayPal. Customer details are protected by the latest security mechanisms and are used only for purposes of fulfilling the transaction. WØRKS does not retain cardholder information.
WØRKS reserves the right to vary these Terms at any time by publishing a revised version of the Terms on this website. The law applicable to this website is the law of the State of Victoria, Australia.
Shipping
The shipment of orders of AUD$100 or more placed via this website will be free of charge to any Australian residential address. The shipment of orders of AUD$99 or less placed via this website will be charged at a flat rate of $12 to any Australian residential address. At the time of checkout, customers must provide a physical residential address for their order to be shipped. We are unable to ship to PO boxes. Customers are required to sign for all deliveries. WØRKS ships orders via Australia Post, Sendle, and a variety of couriers.
WØRKS will use reasonable endeavours to deliver the order within seven (7) business days (Monday-Friday excluding public holidays) to metro areas from the date the order was submitted. Delivery to regional areas may take longer. Please note that WØRKS is unable to support time slot delivery.
WØRKS uses a third-party service to make all deliveries. Customers acknowledge that there may be cases were delivery times are outside of the control of WØRKS, and that WØRKS cannot be held liable for delays in shipping. WØRKS does not currently offer shipping outside Australia.
Orders
WØRKS reserves the right to refuse any order. In such case, WØRKS will notify the customer as soon as reasonably practicable and refund any payment in full. Wholesale orders via this website are not accepted. Products on this website may be ordered for personal use and gifting only. They must not be resold in any form or any place. WØRKS reserves the right to take legal action against the unauthorised and unofficial sale of goods. WØRKS reserves the right to revoke any and all discounts, promotional codes and coupons at any time without notice. In the event that a customer has misused a discount, promotional code or coupon, WØRKS reserves the right to cancel the relevant order/s.
Payment
All prices listed on this website are in Australian Dollars (AUD) and are inclusive of GST. Prices are subject to change without notice. The amount payable to WØRKS for an order (the Order Amount) will be the total cost of every product contained within said order plus shipping if applicable. Customers must pay the Order Amount by credit card at the time of submitting the order via Paypal, Visa or MasterCard.
No warranty
Subject to the following clauses, and to the fullest extent permitted by law, WØRKS gives no warranty for any product sold on this website. Customers are entitled to certain protections under consumer protection legislation. These include the following: that WØRKS is the rightful owner of the products, the products are reasonably fit for their usual purpose, are of acceptable quality, and match any description offered by WØRKS. If WØRKS breaches any of these protections, customers are entitled, at their discretion, to a refund of the purchase price or replacement of the relevant product/s, in addition to seeking compensation for any reasonable or foreseeable loss.
Refunds and returns
All sales are final.
Excluding where consumer protection legislation applies, WØRKS does not accept returns or offer refunds or exchanges on any product.
In the event that an item is damaged during shipping the customer must take photographs clearly showing the damage within 24 hours of receipt, and provide those photographs to WØRKS via email to info@worksproducts.com.au for assessment. Original proof of purchase must also be provided.
Once the damage has been assessed by WØRKS the company will, in its absolute discretion, make a final and binding decision about whether the item may be returned for an exchange or refund. Return postage must be paid by the customer and will then be reimbursed by WØRKS in the original form of payment. It is the responsibility of the customer to retain their postal receipt until they receive confirmation that WØRKS has received the package.
Liability
Subject to the aforementioned protections provided under consumer protection legislation, and to the fullest extent permitted by the law, the liability of WØRKS for any loss or damage suffered by any customer as a result of WØRKS breaching its obligations under these Terms or any other tortious duty (including arising by reason of defects in any product) is limited to a refund or replacement of the relevant product/s. WØRKS accepts no liability that may arise from the information contained on this website, or on any websites linked from this website, being incorrect, incomplete or misleading. To the fullest extent permitted by the law, WØRKS will not be held liable for any loss, damage, cost or expense incurred by, or arising from, any person relying on the information on this website. To the fullest extent permitted by the law, WØRKS limits its liability, where it is entitled to do so, to a refund or replacement of the relevant product/s.
Trademark
WØRKS and all related graphics, photographs, images, logos, and product names are trademarks (both registered and unregistered) of WØRKS Pty Ltd. These trademarks, logos and other proprietary graphics may not be used in connection with any other product, service or brand without the express prior written consent of WØRKS. All content on this website, including text, graphics, logos, photographs, audio and video clips, and data compilations is the property of WØRKS Pty Ltd and is protected by Australian copyright laws.

We periodically send out emails to provide information about our store, new products and other updates. We have a legal obligation to retain certain financial records for financial reporting and account keeping purposes. In addition, we keep a record of all transactions and correspondence so that we may bring claims or defend ourselves in the event of a legal claim or complaint.
Sharing Your Information
WØRKS utilises an online e-commerce platform provided by Shopify.com to enable us to sell products. As a result, Shopify hosts the information that worksproducts.com.au collects and stores that information on secure servers behind a firewall. Shopify's secure servers are located in the USA.
If visitors to worksproducts.com.au complete a purchase, Shopify stores the associated credit card data, which is encrypted via the Payment Card Industry Data Security Standard (PCI-DSS). PCI-DSS is a joint effort by a number of financial institutions including Visa, MasterCard, American Express and Discover, and is managed by the PCI Security Standards Council. The purchase transaction data will be stored only as long as necessary to complete the transaction, after which time the data will be securely deleted.
